How does an assumable mortgage work in Colorado?

FHA, VA AND USDA LOANS CAN BE ASSUMED. CONVENTIONAL ONLY WITH LENDER CONSENT.

Three government loan types can be assumed. FHA loans closed on or after December 15, 1989 require the buyer to pass a credit review (HUD, VERIFIED); VA loans can be assumed by a creditworthy buyer, with a funding fee of 0.5 percent of the balance (VA, VERIFIED); USDA loans can be assumed (PROBABLE). Conventional loans carry a due-on-sale clause that federal law lets the lender enforce, so they are assumed only with the lender's consent (12 U.S.C. 1701j-3, VERIFIED). The buyer pays the gap between price and balance.

    FHA, VA, USDA

    FHA loans closed on or after December 15, 1989 require credit qualification of the assuming buyer (HUD, VERIFIED); VA assumers need not be veterans but must meet VA credit standards (VA, VERIFIED); USDA loans can be assumed under agency rules (PROBABLE).

  2. CONSENT

    Conventional

    Federal law lets a lender enforce a due-on-sale clause on transfer, with listed exceptions that do not include an ordinary sale to an unrelated buyer (12 U.S.C. 1701j-3, VERIFIED). A conventional loan is assumed only if the lender agrees.

  3. SELLER

    Liability and entitlement

    An FHA seller stays liable until the lender releases them (HUD, VERIFIED); a VA seller's entitlement stays encumbered until the loan is paid or an eligible veteran substitutes entitlement (VA, VERIFIED).

  4. GAP

    Price minus balance

    The buyer pays the difference between the price and the assumed balance in cash or with another loan (CFPB, VERIFIED), plus fees: FHA up to $900 and $45 for the release papers (VERIFIED), VA 0.5 percent of the balance at closing (VERIFIED).

Which loans, and who qualifies.

FHA mortgages originated before December 1, 1986 generally contain no restrictions on assumability, while those closed on or after December 15, 1989 require credit qualification of the borrower who wishes to assume (HUD Handbook 4155.1, VERIFIED). HUD requires the creditworthiness review to be completed within 45 days from the date the lender receives all necessary documents (VERIFIED, HUD 4155.1 Chapter 7). A VA loan may be assumed by a buyer who is not a veteran, provided the assumer is creditworthy under VA's credit and underwriting standards; a holder with automatic authority must complete processing within 45 calendar days of a complete application, and a funding fee of 0.5 percent of the loan balance is collected at closing and may not be financed (VERIFIED, VA Circular 26-23-10). USDA guaranteed loans can be assumed, with the lender reporting the transfer to the agency (PROBABLE, from a handbook summary).

Conventional loans are different because federal law lets a lender enter into and enforce a due-on-sale clause when the property is transferred, subject to listed exemptions such as a transfer to a spouse or a transfer on the borrower's death, none of which is an ordinary sale to an unrelated buyer (12 U.S.C. 1701j-3, VERIFIED). The law does not forbid an assumption; it lets the lender refuse one, so a conventional loan is assumed only when the lender agrees in writing, and most do not.

What the seller keeps.

On an FHA loan closed after December 15, 1989, the seller is released from personal liability only if the lender formally releases them after a creditworthy assumer executes an agreement to assume the debt; otherwise the seller remains liable (HUD notice to homeowner, VERIFIED). On a VA loan the original veteran's entitlement remains encumbered by the loan until it is paid in full, unless an eligible, occupying veteran assumer substitutes their own entitlement (VA Circular 26-23-10, VERIFIED).

So an assumption is a decision for the seller too: the release of liability paperwork, or the substitution of entitlement, has to be part of the deal and not an afterthought.

The gap, the fees and the clock.

The difference between the home's sale price and the balance on the assumed loan is what the buyer must pay, in cash or with their own additional loan (CFPB, VERIFIED). On top of it, an FHA lender may charge a processing fee that is reasonable and customary and not more than $900, plus third party costs and up to $45 for the release of liability papers (VERIFIED, FHA Mortgagee Letter 2016-24; the servicer quotes the current cap); a VA assumption carries the 0.5 percent funding fee at closing (VERIFIED). What stalls assumptions in practice is servicer capacity rather than the rule; VA has issued a circular reminding holders of their duty to process assumptions on time (PROBABLE).
