Colorado puts several duties on the seller, wherever the seller lives. The special taxing district disclosure sits on the seller and must be in every residential contract, with damages if it is missing (C.R.S. 38-35.7-101, VERIFIED). HOA documents, the water source and a metropolitan district's website follow, and federal law requires a lead paint disclosure for older housing (40 CFR 745.107, VERIFIED). The disclosure is the seller's duty and is in every residential contract; failure gives the buyer a damages claim (C.R.S. 38-35.7-101, VERIFIED).

In a common interest community the seller provides them, or authorizes the association to provide them, on request (C.R.S. 38-35.7-102, VERIFIED).

The source of the water
The seller states the source of potable water and provides the current well permit if the source is a well and one is available (C.R.S. 38-35.7-104, VERIFIED).

Older housing
A seller of target housing gives the EPA pamphlet, discloses known lead-based paint and hands over available reports before the buyer is obligated (40 CFR 745.107, VERIFIED).
What the Colorado statutes put on the seller.
The obligation to provide the special taxing district disclosure sits on the seller, the disclosure must appear in every residential purchase contract, and a seller who fails to provide it faces a claim for all resulting damages plus court costs (C.R.S. 38-35.7-101, VERIFIED). For a home in a common interest community, the seller must provide the buyer with the association's governing and financial documents or authorize the association to provide them on request (C.R.S. 38-35.7-102, VERIFIED).

The Seller's Property Disclosure form is completed to the seller's actual knowledge as of the disclosure deadline, by the seller and not by the broker (PROBABLE, from the form's description; the Division's site returned an error when read). An owner who never lived in the house still answers from what they know, and can say so on the form. What to write is a question for the seller's attorney.
