A Colorado remote notary must be physically in Colorado, but the signer may be elsewhere in the United States, and the Secretary of State says notaries may remotely notarize deeds and other real estate documents, though it is not required (Colorado Secretary of State, VERIFIED). The packet is mailed to the seller, signed before a notary where the seller lives, and returned. Whether the title company accepts it is its own rule (PROBABLE, practice).
- 03POA
An agent with a recorded power of attorney
The power of attorney must be recorded in the same office as the deed (C.R.S. 38-30-123, VERIFIED), and its signature is presumed genuine when acknowledged before a notary (C.R.S. 15-14-705, VERIFIED).

Ask the title company which method it will close on and whether the county recorder accepts electronic recording of the deed.
What Colorado allows.
The Colorado Secretary of State says a notary cannot perform a remote notarization while physically outside Colorado, that a notary may remotely notarize real estate deeds and other real estate documents, and that doing so is not required (Colorado Secretary of State remote notarization FAQ, VERIFIED). The statute requires the notary to be located in Colorado at the time of the act and lets the signer be in Colorado, elsewhere in the United States, or outside it under stated conditions (C.R.S. 24-21-514.5, VERIFIED).

When a power of attorney is the answer.
When the owner cannot sign at all, an agent under a power of attorney can convey the property, but the power of attorney has to be recorded in the same office as the conveyance (C.R.S. 38-30-123, VERIFIED). A signature on a Colorado power of attorney is presumed genuine if the principal acknowledged it before a notary (C.R.S. 15-14-705, VERIFIED).

Title companies commonly want the original, signed and notarized power of attorney, stating authority over real property, and many want an affidavit that it is still in force if it is older than about 30 days (PROBABLE, from one Colorado title company's practice; others differ). Drafting or choosing a power of attorney is a question for the seller's attorney.

First: which signing method will you close on for this seller, remote online notarization, a mailed packet with a local notary, or a power of attorney, and what identification and originals does each need. Second: does the county recorder accept electronic recording of the deed, because a method that is legal can still be slower if the original must travel.
