How does buying a house in Colorado work when I cannot tour it in person?

THE COLORADO CONTRACT RUNS ON DATED DEADLINES, AND NONE OF THEM REQUIRES YOU IN THE ROOM.

The Colorado contract is a table of dates. Section 3.1 lists every deadline, including earnest money, inspection objection and termination, title objection, loan and appraisal, closing and possession (VERIFIED on the 2019 form; the 2026 form keeps a dates table). Notices and documents can be delivered electronically (PROBABLE), and Colorado's electronic transactions act gives an electronic signature legal effect (C.R.S. 24-71.3-107, VERIFIED). The risk is what a screen cannot show, so the inspection deadline is the one to protect.

  1. DATES

    Section 3.1

    Every deadline sits in one table: earnest money, inspection objection and termination, record title objection, new loan termination, appraisal objection, closing date, possession date (VERIFIED on the 2019 form).

  2. INSPECT

    Section 10.3

    On or before the inspection objection deadline the buyer delivers a written description of unsatisfactory conditions; on or before the termination deadline the buyer may terminate; unresolved by the resolution deadline, the contract terminates (VERIFIED).

  3. SIGN

    Electronic

    An electronic signature has legal effect and satisfies a requirement for a writing (C.R.S. 24-71.3-107, VERIFIED); notices may be delivered by email or a link where the parties fill in an electronic address (PROBABLE, 2019 form).

  4. POSSESS

    Section 17

    Possession is delivered on the possession date and time, which can be set apart from the closing date (VERIFIED).

The Commission's residential contract lists all its deadlines in a table at Section 3.1, including the earnest money deadline, the inspection objection, termination and resolution deadlines, the record title objection deadline, the new loan termination deadline, the appraisal deadline and its objection and resolution dates, the closing date and the possession date (VERIFIED on the 2019 form; the 2026 form keeps the same table with additional items). Earnest money is paid to and held by a named earnest money holder in a trust account for both parties (Section 4.3, VERIFIED).

The buyer's protections are all written notices by those dates. Under Section 10.3 the buyer may deliver a written description of unsatisfactory conditions by the inspection objection deadline and may terminate by the inspection termination deadline; if nothing is resolved by the resolution deadline the contract terminates on its own (VERIFIED). Under Section 6.2, if the appraised value is below the price, the buyer may object or terminate by the appraisal objection deadline (VERIFIED).

Signing and delivery from another state.

Colorado's Uniform Electronic Transactions Act provides that a record or signature may not be denied legal effect or enforceability solely because it is electronic, and that an electronic record or signature satisfies a law requiring a writing or a signature (C.R.S. 24-71.3-107, VERIFIED). The act applies where the parties have agreed to transact electronically, judged from their conduct, and a party that agreed may still refuse to conduct a later transaction electronically (C.R.S. 24-71.3-105, VERIFIED).

The contract's notice section lets notices and documents be delivered in electronic form, by email, by a link to a server, or by fax, where the parties fill in an electronic address (PROBABLE, read on the 2019 form). Financed purchases in this market commonly close in 30 to 45 days after the contract, a pattern the parties set, not a rule (PROBABLE, title company source).

The deadline that stands in for the tour.

What a remote buyer lacks is not a signature; it is a walk through the house. The inspection objection deadline is where that gap is closed: a radon test, a sewer scope, a roof and hail read, a soils question and a metro district check all happen inside it, and each finding is either fixed, priced or a reason to walk before the deadline passes. Set that date with the inspector's calendar in hand, not the seller's preference.
