Can we sell the house before a Colorado divorce is final, and how long is the waiting period?

THE DECREE WAITS AT LEAST 91 DAYS. THE HOUSE CAN CLOSE SOONER, WITH CONSENT OR AN ORDER.

A Colorado court must find that 91 days or more have passed since it acquired jurisdiction over the respondent before it can enter a dissolution decree (VERIFIED, C.R.S. 14-10-106(1)(a)(III)). That is a minimum, not a finish line: the decree is final only when the court enters it (C.R.S. 14-10-120(1), VERIFIED). The house can close earlier only with the other spouse's consent or a court order (an inference from C.R.S. 14-10-107, PROBABLE).

Colorado requires that 91 days or more have elapsed since the court acquired jurisdiction over the respondent, either through process under the civil rules or because the respondent joined as copetitioner, before it can enter a dissolution or legal separation decree (VERIFIED, C.R.S. 14-10-106(1)(a)(III)). A separate rule requires that one party has been domiciled in Colorado for 91 days before the proceeding is commenced (VERIFIED, C.R.S. 14-10-106(1)(a)(I)).

The number is a floor. No rule read lets the minimum be shortened or waived by agreement, and nothing in the statute promises the decree on day 91. A decree is final when it is entered, subject to the right of appeal (C.R.S. 14-10-120(1), VERIFIED).

What can happen to the house inside the window.

While the clock runs, the automatic injunction holds the marital property still unless the other spouse consents in writing or the court orders otherwise (C.R.S. 14-10-107(4)(b), VERIFIED). Either spouse may also move for temporary orders on the payment of debts and the use of property; those orders end when the final decree is entered unless continued for good cause, and they do not decide the final division (C.R.S. 14-10-108, VERIFIED).

Spouses may also sign a separation agreement that disposes of property. Its terms bind the court unless the court finds them unconscionable, and the decree sets out or incorporates it (C.R.S. 14-10-112, VERIFIED). A sale that both spouses have agreed to can be written into that agreement, with the numbers, the date and who signs.

Three ways to line up a sale with the decree.

Wait: list after the decree enters, so the injunction is gone and the decree says who receives what. Consent: both spouses sign a written consent to a specific sale, filed with the court, so the house can close before the decree (PROBABLE, practice). Order: one spouse asks the court to order or permit the sale when the spouses cannot agree.
