What does a seller pay at closing in Colorado, and what changes with a cash offer?

COLORADO FIXES ONE FEE BY STATUTE. EVERYTHING ELSE ON THE SELLER'S SIDE IS A CHECKBOX.

Colorado's statute sets one fee: a documentary fee of one cent for each one hundred dollars of consideration on a deed offered for recording, and none when the consideration is $500 or less (VERIFIED, C.R.S. 39-13-102). Denver adds a flat recording fee of $43 per document (VERIFIED). Closing services, the owner's title policy, any local transfer tax and brokerage compensation are choices the contract leaves to the parties (Sections 15, 8.1 and 29, VERIFIED), so a cash offer changes who pays them only if the offer says so.

What the statute and the city fix.

Colorado's documentary fee is one cent for each one hundred dollars, or major fraction, of the consideration on a deed offered for recording, charged in addition to any other recording fee, and no fee applies when there is no consideration or the total is $500 or less (VERIFIED, C.R.S. 39-13-102). Who pays it is set by the contract, not the statute. The Denver Clerk and Recorder lists a flat $43 recording fee per document and the same documentary fee, and its page names no separate Denver real estate transfer tax (VERIFIED).

What the contract leaves open.

The Commission contract has each party pay its own closing costs in good funds (Section 15.1), lets the parties assign the closing services fee to buyer, seller or a split (15.2), lets either party's box be checked to select the title company and pay for the owner's title insurance policy (8.1), and lets any local transfer tax be assigned the same way (15.4) (VERIFIED). Title insurance premiums are set by the insurers and filed with the Division of Insurance, which tells consumers to shop and compare (Colorado Division of Insurance, VERIFIED).

Buyer brokerage compensation in Section 29 is stated as a percentage or dollar amount and is paid by the seller, by the buyer under a separate buyer brokerage agreement, or between the brokerage firms; the form fixes no amount (VERIFIED). Since August 12, 2026 a broker may not perform licensed activity without a signed written agreement that specifies and conspicuously discloses the amount or rate of compensation (Colorado Division of Real Estate advisory on HB26-1426, VERIFIED).

What a cash offer changes, and what it does not.

On a cash sale with no brokerage on the buyer's side and a discounted price, the two lines most likely to shrink are brokerage compensation and, in dollar terms, the fee base tied to the lower price; no source read here states a standard percentage saved, and the documentary fee, the closing services fee and the disclosure duties do not go away (PROBABLE, an inference from the contract's negotiable lines).
