Which Colorado contract deadlines does an assumption or a contingent purchase have to fit inside?

LOAN, APPRAISAL AND CONDITIONAL SALE DEADLINES ARE THREE CLOCKS. TWO CAN END THE DEAL.

The contract's Section 3.1 table holds them all: the new loan application, terms and availability deadlines, the existing loan and existing loan termination deadlines, the loan transfer approval deadline, the appraisal, appraisal objection and appraisal resolution deadlines, and the conditional sale deadline (VERIFIED). An assumption lives in the existing loan and transfer approval dates; a contingent purchase in the conditional sale date; and every buyer in the appraisal dates.

  1. LOAN

    Application and terms

    The buyer must make a verifiable loan or assumption application by the new loan application deadline and use reasonable efforts to obtain it (Section 5.1, VERIFIED).

  2. ASSUMPTION

    Existing loan and transfer approval

    The seller delivers the loan documents by the existing loan deadline; the buyer may terminate by the existing loan termination deadline (Section 5.4, VERIFIED); the contract terminates if the lender's written consent is not received by the loan transfer approval deadline (Section 4.6, VERIFIED).

  3. APPRAISAL

    Objection and resolution

    If the appraised value is below the price, or the appraisal is not received by the appraisal deadline, the buyer may object or terminate by the appraisal objection deadline; unresolved by the resolution deadline, the contract terminates (Section 6.2.1, VERIFIED).

  4. SALE

    Conditional sale

    The purchase is conditional on the sale and closing of the buyer's named property; a notice to terminate must arrive by the conditional sale deadline or the right is waived (Section 10.7, VERIFIED).

The table.

Section 3.1 of the Commission's contract is a numbered table of dates and deadlines; among its items are the new loan application, new loan terms and new loan availability deadlines, the existing loan and existing loan termination deadlines, the loan transfer approval deadline, the appraisal, appraisal objection and appraisal resolution deadlines, and the conditional sale deadline (VERIFIED). Section 5.1 requires the buyer, if the lender requires it, to make an application verifiable by the lender on or before the new loan application deadline and to exercise reasonable efforts to obtain the loan or the approval (VERIFIED).

The clocks that end the contract.

For an assumption, Section 5.4 requires the seller to deliver copies of the loan documents, including the note, the deed of trust and any modifications, by the existing loan deadline; and lets the buyer terminate before the existing loan termination deadline if the provisions are unsatisfactory (VERIFIED); Section 4.6 terminates the contract if the lender's written consent to the assumption is not received by all parties and the closing company before the loan transfer approval deadline (VERIFIED). For every buyer, Section 6.2.1 gives the right to an appraisal; if the appraised value is below the purchase price, or the appraisal is not received by the appraisal deadline, the buyer may object or terminate by the appraisal objection deadline, and if nothing is agreed in writing by the appraisal resolution deadline the contract terminates on that date (VERIFIED).

For a contingent purchase, Section 10.7 uses its own conditional sale deadline: the buyer has the right to terminate on notice received by that date if the named property has not sold and closed, and the right is waived if the notice does not arrive (VERIFIED). FHA and VA buyers also have Sections 6.2.2 and 6.2.3, which say the buyer is not obligated to complete the purchase or forfeit earnest money unless given a written appraised value statement under HUD or VA requirements of not less than a stated amount (VERIFIED).

Setting the dates from real answers.

Every one of these is a blank the parties fill in, so the right way to set them is from the answers to the servicer's and the lender's questions: the servicer's realistic approval time sets the loan transfer approval deadline, the appraiser's calendar sets the appraisal deadline, and the listing plan on the current home sets the conditional sale deadline. A date set from hope terminates the contract on schedule.
