Does a cash offer change what I must disclose when selling a house in Colorado?

What the form says about itself.

The Commission's Seller's Property Disclosure, for use on or after January 1, 2026, states that the seller's answers are correct to the seller's current actual knowledge, that the disclosure is not a warranty and is not a substitute for an inspection, and that if the seller has knowledge of an adverse material fact affecting the property or its occupants it must be disclosed whether there is a specific item on the form or not (SPD19, VERIFIED). Nothing in the form exempts a cash sale, an as-is sale or an investor buyer.

An as-is clause changes who carries the risk of what nobody knows. It does not change the duty to tell the buyer what the seller does know. Colorado's courts have long held that a seller must disclose known latent defects, and that the duty is independent of the form's categories (Colorado Lawyer, VERIFIED).

What the statutes put on the seller.

Every residential purchase contract must contain the special taxing district disclosure and the common interest community disclosure; the obligation is the seller's, and a buyer who does not receive them has a claim for all resulting damages plus court costs (C.R.S. 38-35.7-101 and 102, VERIFIED). The seller must also disclose in writing, at or before the sale, whether the seller knows the property was previously used as a methamphetamine laboratory (C.R.S. 38-35.7-103, VERIFIED). Each statute applies to the contract itself, not to a class of buyer.

The federal rule, and what to gather.

The federal lead based paint rule requires sellers of most housing built before 1978 to disclose known lead based paint and hazards, provide the EPA pamphlet and give the buyer a ten day opportunity to inspect; its exceptions are specific kinds of housing and foreclosure sales, and a cash purchase is not among them (EPA, VERIFIED).
